This Nido Privacy Policy (“Privacy Policy”) is meant to assist you in understanding the information that Savvy Living LLC (“Nido,” “we,” “our,” or “us”) collects when you use the Nido mobile application (“App”), the Nido website (“Website”), and other Nido programs and services from which you are accessing this Privacy Policy (collectively, the “Services”) and how Nido uses, discloses and safeguards that information.

This Privacy Policy applies only to Nido and the information we collect. This Privacy Policy does not apply to the privacy and data practices of third parties, including landlords and property owners and those third parties we may link to or reference on our Services, like real estate agents and mortgage brokerages (collectively, “Outside Third Parties”). The privacy and data practices of Outside Third Parties are governed by their own respective privacy policies, and we are not responsible for the information practices of such Outside Third Parties. In addition, please note that if you are an employee of a landlord or property manager, our use and disclosure of information about you and your use of the Services in such role is governed by our agreement with the landlord or property manager rather than by this Privacy Policy.

The Effective Date of this Privacy Policy is set forth at the top of this page. This Privacy Policy is subject to change. Any changes to the Privacy Policy will be published on the Nido Website and App. Your continued use of the Services after the Effective Date constitutes your acceptance of the amended Privacy Policy. The amended Privacy Policy supersedes all previous versions. Accordingly, please refer back to this page frequently.

I. Information We Collect

We collect personally identifiable information from you through your use of the Services and from Outside Third Parties (“Personally Identifiable Information”). Personally Identifiable Information is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual.

1. Information You Provide

We may collect the following Personally Identifiable Information that you voluntarily provide to us:

  • Your first name, last name, phone number, and email address.
  • Information you provide when you engage with the chatbot available through the Services.
  • Your rental address, rent amount, lease start date and/or end date, and rent payment due date.
  • Your home buying goals and goal progress, including where you would like to buy a home, the type of home you are looking for, the timeframe for you to make your home purchase, self-reported gross annual income, self-reported annual household income, self-reported monthly debt, self-reported credit score, how much you’ve saved so far, how many people live in your household, estimated purchase price, down payment amount, interest rate, payment term, taxes, insurance, monthly homeowner’s association/condo fees, and your down payment assistance program.
  • If you create an account and submit feedback through the App, Website, or email, your login information, name, email address, and a photograph if you’ve uploaded one to your account.
  • If you contact us, your name, email address, and any other information you provide to us.

 

2. Information From Outside Third Parties

As you utilize the Nido Services, we may collect the following Personally Identifiable Information from Outside Third Parties, including property owners or landlords that you rent from:

  • Your first name, last name, phone number, and email address.
  • Your rental address, rent amount, lease start date and/or end date, and rent payment due date.

 

3. Information as You Use Our App, Website, and Other Nido Services

We may automatically collect the following Personally Identifiable Information through your use of the Nido Services, including the App and Website:

  • The pages of the App and Website you access, how often you access certain pages on the App and Website, and what you click on when accessing the App and Website.
  • Information regarding which device you are using to access the App and Website, including hardware model, operating system, application version number and browser.
  • Information regarding whether you are accessing our App or Website through a mobile device or tablet and, if so, what device you are using to access the App or Website and your mobile device carrier.
  • Your IP address.
  • Access times.
  • Location information from App and Website visitors on a city-regional basis.
  • Other technical information such as protocol status and substatus, bytes sent and received, and server information.

4.Information Sharing for Home Purchase Transactions

In the course of facilitating home purchase transactions, Nido Rewards may share certain information with Real Estate Agents, Mortgage Brokerages, and Mortgage Lenders in connection with Nido Services. This information transfer is restricted to the parties specifically assigned to the buyer and is necessary to facilitate communication and reward reconciliation between all parties involved, and only made available after your initiation via the mobile application to connect with such services. The types of information that may be shared include, but are not limited to:

  • Total Available Nido Rewards
  • Pre-Approval Information
  • Agreement of Sale
  • Loan Commitment Details
  • Settlement Documents

Additionally, by agreeing to this privacy agreement, the buyer consents to allow their assigned mortgage lender and real estate agent to share the aforementioned information with Nido Rewards. This exchange of information is essential for aiding the home purchase process and ensuring accurate reward reconciliation. Under no circumstances is this information sold to third parties. Nido Rewards is committed to maintaining the confidentiality and security of your personal information throughout this process.

5. Information Related To Third Parties

When you access and use the Nido Services, we may receive Personally Identifiable Information related to third parties. For example, if you enroll in our Nido Rewards program(s), you may provide the name, email address, and/or phone number of a third party. If you submit any Personally Identifiable Information about another individual to us, you are responsible for ensuring that you have the authority and any necessary consents and permissions to share such Personally Identifiable Information given the understanding that you are also allowing us to use that third party’s Personally Identifiable Information in accordance with this Privacy Policy.

II. How We Use Your Personally Identifiable Information

We use the Personally Identifiable Information we collect to provide the Nido Services, improve the Nido App and Website, and to protect our legal rights. Additionally, we may use the Personally Identifiable Information we collect to:

  • Process your Nido account registration,
  • Provide the Nido Services, including Nido Rewards,
  • Provide you access to the Nido Services and features,
  • Contact you regarding our products and services that we feel may be of interest to you,
  • Communicate with you about the Nido Services including the Nido App and Website and of changes to the Nido Services including the Nido App and Website,
  • Provide support and customer service,
  • Maintain and improve the Nido Services, including the App and Website,
  • Defend our legal rights and the rights of others,
  • Respond to requests from public and government authorities,
  • Enforce this Privacy Policy and our Terms of Use
  • Efficiently maintain our business, including by performing data analysis and audits, developing new products and services, enhancing and improving our Services, identifying Service usage trends, technical troubleshooting, and
  • Comply with applicable law.

III. How We Share Your Personally Identifiable Information

We may share the Personally Identifiable Information we collect with the following:

  • Service providers to perform data, App, or Website-related services on our behalf (e.g., hosting, maintenance, backup, analysis, to provide the chatbots on the Services, etc.),
  • Outside Third Parties that you choose to work with, including real estate agents, mortgage brokerages, and mortgage lenders, in connection with the Nido Services, including Nido Rewards. We will not share information with these Outside Third Parties without your initiation via the mobile app to connect with such services,
  • Governmental authorities or other entities and individuals as required by law or legal process,
  • Governmental authorities or other entities and individuals as needed in connection with legal proceedings or prospective legal proceedings,
  • Any other person or entity as part of any corporate transaction, such as such as a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy, and
  • Any other person or entity where you consent to the disclosure.

Additionally, we may share the Personally Identifiable Information that we collect to establish, exercise, or defend our legal rights, including providing information to others for the purposes of fraud prevention.

We do not share your Personally Identifiable Information with third parties for those third parties’ direct marketing purposes.

IV. Cookies, Web Beacons, and Other Tracking Technologies 

1. How We Use Cookies, Web Beacons, and Other Tracking Technologies

We use tracking technologies, such as cookies, web beacons and other tracking technologies, to collect information about your interactions with the Nido Services, including the Nido App and Website.

A cookie is a small file containing a string of characters that is sent to your computer when you visit a website or use an online service. When you visit the website or use the service again, the cookie allows that website or online service to recognize your browser or device. Cookies may store unique identifiers, user preferences and other information.

Cookies help us improve the Services by providing us with information about which parts of the Services are most popular, enabling us to analyze technical and navigational information about the Services, and helping us to detect and prevent fraud. We also use cookies and other data collection tools (such as web beacons and server logs) to help improve your experience with the Services. These tools use cookies to collect standard Internet log information and visitor behavior information in an anonymous form. The information generated by the cookie about your use of the Services (including IP address) is transmitted to our data collection tool service providers. This information is then used by us to evaluate visitors’ use of the Services and to compile statistical reports on website activity for Nido.

 

2. How You Can Opt-Out of Cookies

a. Browser Settings

Cookies can be blocked by changing your internet browser settings to refuse all or some cookies. If you choose to block all cookies (including essential cookies) you may not be able to access all or parts of the App and Website.

b. Advertising Industry Resources

You can understand which entities have currently enabled Cookies for your browser or mobile device and how to opt-out of some of those Cookies by accessing the Network Advertising Initiative’s website or the Digital Advertising Alliance’s website. For more information on mobile specific opt-out choices, visit the Network Advertising Initiative’s Mobile Choices website.

Please note that these opt-out mechanisms are specific to the device or browser on which they are exercised. Therefore, you will need to opt out on every browser and device that you use.

V. “Do Not Track” Signals

Some internet browsers incorporate a “Do Not Track” feature that signals to websites you visit that you do not want to have your online activity tracked. Given that there is not a uniform way that browsers communicate the “Do Not Track” signal, the Services do not currently interpret, respond to or alter its practices when it receives “Do Not Track” signals. VI. Choices About Your Personally Identifiable Information

a. Review and Request Changes to Your Personally Identifiable Information

You may use your Nido account to access, correct, or view certain Personally Identifiable Information that is associated with your Nido account. To review or request changes to any of your Personally Identifiable Information, please contact us at info@nidorewards.com.

To unsubscribe from our marketing emails, please click the unsubscribe link included in the footer of our emails. You also may submit a request to us at info@nidorewards.com.

VII. Security

We maintain commercially reasonable security measures to protect the Personally Identifiable Information we collect and store from loss, misuse, destruction, or unauthorized access.  However, no security measure or modality of data transmission over the Internet is 100% secure.  Although we strive to use commercially acceptable means to protect your Personally Identifiable Information, we cannot guarantee absolute security. It is your responsibility to protect the security of your login information.

VIII. Third Party Links

The Nido Services, including the App and Website, may contain links that will let you leave the Website or App and access another website. Linked websites are not under our control. This Privacy Policy applies solely to Personally Identifiable Information that is collected by us through the App and Website. We accept no responsibility or liability for these other websites or any other Outside Third Parties.

IX. Children’s Privacy

The Nido Services, including the App and Website, are not intended for children under 18 years of age. We do not knowingly collect, use, or disclose personal information from children under 18.
